Mediation is defined as a process in which a Mediator or as often termed a third party neutral, facilitates communication and negotiation between parties to assist them in reaching a voluntary agreement regarding their dispute. While the Court may refer some cases to mediation, it is not a legal proceeding. Mediation is an informal and non-adversarial process, and the primary objective is to aid disputing parties in reaching a mutually acceptable agreement. The Mediator is not the judge, arbitrator, trier of fact or decision maker in the mediation process. The Mediators function is to assist the participants in identifying issues, explore settlement options and to encourage the participants to work together to solve their problems.
